1. Acceptance of Terms

Welcome to Appraise.net ("we," "our," or "us"). By accessing or using our website and services, you ("user," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Appraise.net. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of our services after any changes indicates your acceptance of the new Terms.

2. Description of Service

Appraise.net provides AI-powered domain name appraisal services, including but not limited to:

  • Automated domain valuation analysis
  • Market intelligence and comparable sales data
  • Historical domain tracking
  • Professional appraisal reports
  • API access for enterprise users

Our services are provided on a credit-based system, where each appraisal consumes credits from your account balance.

3. User Accounts and Registration

To access certain features of our service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Keep your login credentials secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities under your account

You must be at least 18 years old to create an account and use our services.

4. Payment Terms

Our services operate on a subscription and credit-based model. Payment terms include:

  • Subscriptions: Monthly recurring charges for credit allotments
  • Credit Packs: One-time purchases for additional credits
  • Payment Processing: All payments are processed securely through Stripe
  • Billing: Subscription fees are charged monthly in advance
  • Taxes: You are responsible for all applicable taxes

Credits do not expire but are non-transferable and non-refundable except as required by law.

5. Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard. Upon cancellation:

  • Your subscription will remain active until the end of the current billing period
  • You will retain access to any remaining credits in your account
  • No refunds will be provided for the current billing period
  • No refunds will be provided for unused credits

We reserve the right to issue refunds at our sole discretion in exceptional circumstances.

6. Affiliate Program

Appraise.net operates an affiliate program that allows approved participants to earn commissions by referring new customers. By participating in the affiliate program, you agree to the following terms:

6.1 Program Structure

Our affiliate program is a standard, single-level affiliate program. Affiliates earn commissions directly from Appraise.net for customers they personally refer. This is not a multi-level marketing (MLM) program.

6.2 Commission Structure

Approved affiliates earn recurring commissions on referred customer subscriptions according to the following decreasing schedule:

  • Year 1: 20% of monthly subscription revenue
  • Year 2: 15% of monthly subscription revenue
  • Year 3: 10% of monthly subscription revenue
  • Year 4 and Beyond: 7.5% of monthly subscription revenue

Commission Duration: Commissions are calculated on the actual amount paid by the customer after any discounts or promotional offers. Commissions continue for the duration of the referred customer's active subscription, subject to the following conditions:

  • Commissions cease if the customer cancels their subscription
  • Commissions cease if the affiliate account is terminated for any reason
  • Commissions are subject to program continuation (see Section 6.6)
  • The term "lifetime" or "recurring" refers to the duration of the customer's subscription, not the affiliate's or company's lifetime

6.3 Anti-MLM Provisions

To maintain compliance with federal and state regulations and to ensure a transparent affiliate program, the following restrictions apply:

  • No Sub-Affiliate Commissions: Affiliates do not earn commissions on sales made by other affiliates they recruit
  • No Recruiting Bonuses: There are no bonuses or commissions for recruiting other affiliates
  • No Multi-Level Structure: All affiliates earn directly from Appraise.net, not from other affiliates
  • Direct Relationships Only: Each affiliate has a direct contractual relationship with Appraise.net

Affiliates may hire helpers or assistants to distribute their promotional materials, but all commissions are paid solely to the approved affiliate who owns the coupon codes. Appraise.net has no relationship with such helpers.

6.4 Coupon Codes and Attribution

Affiliates may create unlimited promotional coupon codes for customer acquisition. Customer attribution is determined by:

  • Use of affiliate coupon codes at checkout (primary attribution method)
  • Referral links with affiliate tracking parameters
  • Manual claims verified by Appraise.net staff

Affiliates are responsible for ensuring their promotional activities comply with all applicable laws, including truth-in-advertising regulations and FTC endorsement guidelines.

6.5 Payment Terms for Affiliates

Affiliate commission payments are subject to the following terms:

  • Minimum Payout: $50.00 accumulated commission balance required
  • Payment Schedule: Monthly, processed on the first business day of each month
  • Payment Methods: PayPal, bank transfer, or other methods as agreed
  • Tax Responsibility: Affiliates are responsible for all applicable taxes on commission income
  • 1099 Reporting: Affiliates earning over $600 annually will receive IRS Form 1099-NEC

6.6 Affiliate Application and Approval

Participation in the affiliate program requires application and approval. We reserve the right to:

  • Approve or reject any affiliate application at our sole discretion
  • Suspend or terminate affiliate accounts for violations of these terms
  • Modify commission rates for future referrals (existing referrals maintain their original rates)
  • Require affiliates to meet minimum performance standards
  • Modify, suspend, or terminate the affiliate program at any time with 30 days' notice
  • Change program terms with notice to active affiliates, with changes applying to future referrals only

Program Continuity Disclaimer: While we intend to maintain the affiliate program long-term, Appraise.net reserves the right to discontinue or materially modify the program. In the event of program termination, affiliates will be notified 30 days in advance, and existing commission obligations for active subscriptions at the time of notice will be honored through a reasonable transition period as determined by Appraise.net.

6.7 Prohibited Affiliate Activities and Anti-Abuse Provisions

The integrity of our affiliate program depends on trust and compliance with these rules. Affiliates may not engage in the following activities:

Marketing and Advertising Restrictions:

  • Making false or misleading claims about our services
  • Using unauthorized branding or trademark violations
  • Engaging in spam or unsolicited commercial email
  • Bidding on our trademarked terms in paid search advertising
  • Promising guaranteed returns or specific financial outcomes
  • Operating the affiliate program as an MLM or pyramid scheme

Self-Referral and Fraud Prohibitions:

  • No Self-Use: Affiliates may not use their own coupon codes for personal purchases or subscriptions. Affiliate coupons are intended to acquire new customers, not provide discounts to the affiliate themselves.
  • No Family/Household Use: Affiliates may not have immediate family members or household members use their coupon codes to circumvent the self-use prohibition.
  • No Fake Accounts: Creating fake accounts or using fictitious identities to generate commissions is strictly prohibited.
  • No Account Manipulation: Using multiple accounts, VPNs, or technical means to artificially inflate referrals or commissions.
  • No Payment Reversals: Intentionally referring customers likely to request refunds or chargebacks.
  • No Cookie Stuffing: Manipulating tracking cookies or referral attribution systems.

Detection and Monitoring:

Appraise.net employs automated and manual fraud detection systems to identify suspicious patterns, including but not limited to:

  • Account matching (email, IP address, payment methods, device fingerprinting)
  • Usage patterns and behavioral analysis
  • Transaction velocity and anomaly detection
  • Geographic and demographic pattern analysis

Consequences for Violations:

Violation of these provisions will result in immediate action, which may include:

  • Immediate Termination: Affiliate account permanently closed without notice
  • Commission Forfeiture: All unpaid commissions forfeited, regardless of legitimacy
  • Clawback of Paid Commissions: Previously paid commissions may be recovered via legal means
  • Account Suspension: All associated Appraise.net accounts (affiliate and customer) suspended
  • Legal Action: Fraudulent activity may be reported to authorities and pursued legally
  • Industry Blacklist: Serious violations may be reported to affiliate fraud databases

Good Faith and Trust:

Our affiliate program operates on a foundation of trust. While we implement technical safeguards, we expect affiliates to act in good faith and with integrity. If you discover a loophole or potential abuse vector, we encourage you to report it to affiliates@appraise.net rather than exploit it. Responsible disclosure may be rewarded; exploitation will be penalized.

Final Determination: Appraise.net reserves the sole right to determine whether a violation has occurred. Decisions regarding violations are final and not subject to appeal. We may terminate affiliate relationships at any time, for any reason, at our sole discretion.

6.8 Appreciation for Affiliate Recruiting

While affiliates do not earn commissions for recruiting other affiliates, we may, at our sole discretion, provide recognition, awards, or appreciation gifts to affiliates who refer high-quality candidates to the program. Such recognition is not guaranteed and does not constitute a commission or payment structure.

6.9 Customer Privacy and Data Protection

Anonymized Reporting: To balance affiliate transparency with customer privacy rights, all customer information displayed in affiliate dashboards is anonymized. Affiliates will have access to:

  • Anonymized customer identifiers (e.g., "REF-abc12345")
  • Partial email masking (e.g., "j***5@g***.com")
  • Initials or generic names (e.g., "J. D." or "Customer")
  • Complete commission and transaction details
  • Subscription tier and status information
  • Coupon code usage and performance metrics

No Direct Customer Contact: Affiliates do not receive full customer contact information, including complete names, email addresses, phone numbers, or payment details. This protects customer privacy in compliance with applicable privacy laws (GDPR, CCPA, etc.).

Commission Verification: All commission calculations are fully transparent and verifiable through the affiliate dashboard. Disputes regarding commissions should be directed to affiliates@appraise.net with the reference ID of the transaction in question.

Legal Disclosures: Full customer information may only be disclosed to affiliates if: (a) the customer explicitly consents to such disclosure, (b) required by law or valid legal process, or (c) necessary to resolve a specific dispute as determined solely by Appraise.net.

7. Acceptable Use

You agree to use our services only for lawful purposes. You may not:

  • Use our services for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit any harmful or malicious code
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our services
  • Share your account credentials with third parties
  • Use automated systems to abuse our services
  • Resell or redistribute our services without permission

8. Intellectual Property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, software, and data, are owned by Appraise.net and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use our services for your personal or business purposes in accordance with these Terms.

9. Data and Privacy

We collect and process your personal information in accordance with our Privacy Policy. By using our services, you consent to such collection and processing. We implement appropriate security measures to protect your data, but cannot guarantee absolute security.

You retain ownership of any domain names you submit for appraisal. We may use aggregated, anonymized data for improving our services and market analysis.

10. Disclaimers and Limitations

Service Availability: We strive to maintain 99.9% uptime but do not guarantee uninterrupted service availability.

Accuracy Disclaimer: Our domain appraisals are estimates based on algorithmic analysis and market data. They should not be considered as definitive valuations or investment advice. Actual domain values may vary significantly.

No Warranty: Our services are provided "as is" without warranties of any kind, either express or implied.

11. Limitation of Liability

To the maximum extent permitted by law, Appraise.net shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claims arising from or related to these Terms or our services shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Appraise.net and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to our services at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use our services will cease immediately.

Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Maricopa County, Arizona.
